REFUND POLICY – DIGITAL PRODUCTS

1. Overview

This Refund Policy governs the conditions under which refunds may be requested for digital products purchased through The Midnight Empire (hereinafter "the Store"). By completing a purchase, the Customer confirms they have read, understood, and agreed to this policy in its entirety.

All products sold through The Midnight Empire are exclusively digital in nature — including but not limited to ebooks, audio files, guides, and bundles — and are delivered via direct download or access link. As such, they are not subject to the return regulations applicable to physical goods.


2. Waiver of Right of Withdrawal (EU Customers)

Pursuant to Article 16(m) of EU Directive 2011/83/EU, the 14-day right of withdrawal does not apply to digital content provided on a non-tangible medium where delivery has begun with the Customer's prior express consent.

By completing a purchase and requesting immediate access to digital content, the Customer expressly acknowledges that they waive their right of withdrawal at the moment the file is made available for download or access is activated.

This waiver is confirmed through a mandatory, unchecked checkbox at checkout, the acceptance of which is recorded with a date and time stamp.


3. Eligible Grounds for a Refund

The Midnight Empire will consider refund requests exclusively in the following circumstances:

a) Defective or Inaccessible Product The file is corrupted, the download link is non-functional, or the content cannot be accessed due to a technical issue attributable to the Store. The Customer must report the issue within 14 days of purchase. The Store will first attempt to resolve the technical problem or replace the file. A full refund will only be issued if the issue cannot be resolved.

b) Accidental Duplicate Purchase The Customer has accidentally purchased the same product twice. The refund will be applied to the second transaction, subject to verification by the Store.

c) Product Significantly Misrepresented The content of the product is objectively and materially different from what was described on the sales page. Subjective dissatisfaction, unmet personal expectations, or a change of preference do not fall under this category.


4. Non-Eligible Grounds for a Refund

Refunds will not be granted in the following circumstances:

  • The file has been downloaded or the access link has been opened, regardless of whether the Customer claims not to have consumed the content
  • The Customer has changed their mind after purchase without any technical fault being present
  • The Customer states they did not have time to use the product
  • The request is submitted outside the timeframe specified in this policy
  • The Customer has previously received a refund for the same product or has a history of refund abuse
  • The product was purchased as part of a promotional offer or discounted bundle, unless a technical fault is present

5. Product-Specific Conditions

Ebooks and PDF Files Refunds are not applicable once the file has been downloaded, regardless of how much of the content the Customer claims to have read.

Audio Files Refunds are not applicable once the audio file has been downloaded or played, even partially, whether via online player or direct download.

Guides and Educational Materials Refunds are not applicable once the content has been made accessible and the download link has been used.

Bundles and Multi-Product Packages Partial refunds on individual items within a bundle are not available. Where a refund is approved, it will apply to the entire purchase, with immediate revocation of access to all included content.


6. How to Request a Refund

To submit a refund request, the Customer must follow the procedure below:

  1. Send an email to help@themidnightempire.com within 14 days of the purchase date
  2. Use the subject line: "Refund Request – [Order Number]"
  3. Include in the body of the email: order number, product name, and a detailed explanation of the reason for the request
  4. Allow up to 3 business days for a response from our team

Requests that are incomplete, missing an order number, or submitted beyond the stated timeframe will not be considered. The Midnight Empire reserves the right to request additional information before proceeding with any refund assessment.


7. Refund Method and Processing Times

Refund Method All approved refunds are issued exclusively to the original payment method used at the time of purchase — whether credit/debit card, PayPal, or another payment method. Refunds to an alternative payment method are not available.

Alternative: Store Credit As an alternative to a refund to the original payment method, the Customer may choose to receive store credit equal to the value of the purchase. Store credit has no expiration date and can be applied to any product in The Midnight Empire catalogue.

Refund Amount Approved refunds are issued for 100% of the amount paid. Any transaction fees charged by the payment processor (e.g. PayPal, Stripe) are non-refundable, as these are retained directly by the payment processor and are beyond The Midnight Empire's control.

Currency Refunds are issued in the same currency as the original transaction. The Midnight Empire is not responsible for any differences arising from exchange rate fluctuations between the date of purchase and the date of the refund.

Processing Timeline

  • Request assessment: within 3 business days of receiving the email
  • Refund processing upon approval: within 5 business days
  • Credit to the Customer's account: an additional 5–10 business days, depending on the Customer's bank or payment processor

8. Revocation of Access

Upon approval of a refund, access to all associated digital content is revoked immediately and simultaneously with the processing of the refund. The Customer agrees not to retain, distribute, reproduce, or make any further use of the files or content received.


9. Abuse Prevention

The Midnight Empire actively monitors refund activity and reserves the right to:

  • Decline refund requests from Customers who have previously submitted more than one refund request
  • Permanently restrict Store access to Customers found to be abusing this policy
  • Report fraudulent behaviour to the relevant authorities where applicable

10. Chargebacks

The Customer agrees not to initiate a chargeback with their bank or payment processor without first contacting The Midnight Empire at help@themidnightempire.com and allowing up to 5 business days for a response.

In the event of an unjustified chargeback, The Midnight Empire reserves the right to dispute the claim by submitting all available documentation — including the recorded checkout consent, download timestamp, order confirmation email, and any correspondence with the Customer — and to seek reimbursement of any associated banking fees incurred as a result.


11. Policy Updates

The Midnight Empire reserves the right to amend this policy at any time. Changes take effect upon publication on the website. The version of this policy applicable to any given purchase is the one in force at the time of the transaction.
